We inform all interested parties that Kazakhs applicants can obtain protection for their industrial design in the territory of most of the CIS countries by filing a Eurasian application for a Eurasian patent valid in the territory of the following CIS countries - the Kyrgyz Republic, the Republic of Azerbaijan, the Republic of Armenia, the Russian Federation and The Republic of Kazakhstan.
A regional patent granted in this way is valid for 25 years from the filing date of the application.
Since July 2021, the possibility of filing applications for the grant of Eurasian patents for industrial designs through the Kazpatent has been opened.
The Eurasian application is filed through the Kazpatent in duplicate, in accordance with Article 13 (2) of the Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention of 09.09.1994.
The application form for the grant of a Eurasian patent for an industrial design and the Procedure for filling them out are posted on the web portal of the Eurasian Patent Organization in the section "Documents/Application Forms".
The requirements for the applicant's registration of documents for a Eurasian application are regulated by the Rules for Drawing Up and Filing an Application for the Grant of a Eurasian Patent for an Industrial Design, the Patent Instruction to the Eurasian Patent Convention (Part II Industrial Designs) (hereinafter referred to as the Instruction), which are posted on the web portal of the Eurasian Patent Organization, in section "Documents/Issues of legal protection of industrial designs".
This section also contains the texts of the Patent Regulations to the Eurasian Patent Convention (Part II. Industrial Designs).
Kazpatent checks the Eurasian application for compliance with the requirements of Rule 102 and 103 of the Instruction and sets the date of its filing in accordance with Rule 101 of the Instruction.
According to the Eurasian application, which has passed the check with a positive result, Kazpatent transmits it to the Eurasian Office.
Each Eurasian application must be accompanied by the payment of a processing, verification and transmission fee for the Eurasian application (Rule 102 (2) of the Regulations).
